Please read the following Terms and Conditions before purchasing from www.boopandfloof.com website. This website is operated by BOOP&FLOOF LTD.
The access and use of the service provided by BOOP&FLOOF is conditioned on your acceptance and compliance with the following Terms regardless of purchase.
By accessing or using the service provided by BOOP&FLOOF you agree to be bound by these Terms. If you disagree with any of the following Terms then you can not access the service provided by BOOP&FLOOF.
All service users are encouraged to be familiar with the Sale of Goods Act 1979, Unfair Contracts Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999.
Purchases of any products from BOOP&FLOOF require certain information relevant to the purchase. This includes but is not limited to credit or debit card numbers, expiry date of the credit or debit card, the billing address and shipping information of the purchaser.
By purchasing products from BOOP&FLOOF you state that you have the legal right to use a debit or credit card or any other payment type linked to the purchase. You state that the information supplied by you is true, correct and complete.
By accessing this service, you agree that BOOP&FLOOF is not responsible for any loss or damages that may happen due to the supplying of false or inaccurate information.
You agree that upon submitting your information, you grant BOOP&FLOOF the right to pass on information to third parties for purposes of facilitating the completion of your purchase.
Any competitions run by BOOP&FLOOF are excluded from these Terms and Conditions. Separate Terms will be posted alongside each competition. Participants are expected to read these Terms and by entering are agreeing to them.
BOOP&FLOOF offers a First Box Free service on multi pack subscriptions, you are required to enter your billing information for this and are contracted to continue the subscription after receiving the first box. You will not be charged until the billing date for your second box.
If payment fails or the subscription gets cancelled for any reason after the receiving of the first box, you will be charged accordingly. More details of this can be found under the ‘SUBSCRIPTION’ section of the Terms and Conditions.
By creating an account with BOOP&FLOOF you agree to provide complete information that is accurate and current at all time. You must contact BOOP&FLOOF immediately via the ‘Contact Us’ section of the website or by emailing firstname.lastname@example.org of any changes to the information provided. Failure to do so is a breach of the Terms which may result in the immediate termination of your account and subscription.
It is your sole responsibility to safeguard the password used for the account created on the BOOP&FLOOF website.
The multi-plan subscriptions are billed on a monthly basis. You will be billed in advance on a recurring basis.
Your subscription will renew automatically under the same conditions previously selected by you unless you or BOOP&FLOOF cancels it. Your subscription can be cancelled after your monthly subscription before the renewal date through your online account. You may also contact BOOP&FLOOF customer support to do this.
You will need a valid payment method such as a PayPal account, credit or debit card to process the payments for your subscription. By purchasing a subscription, you are agreeing that you are providing BOOP&FLOOF with accurate, valid and complete billing information. By submitting this information, you are authorising BOOP&FLOOF to charge all subscription fees incurred through your account to any such payment instructions.
If the automatic billing method fails for any reason, BOOP&FLOOF LTD will issue electronic invoices indicating that you must proceed manually, with the deadline date stated on such invoice. The full payment corresponding to the billing period will be stated on the invoice along with full instructions on how to proceed. You will be charged accordingly.
Your subscription can be cancelled by BOOP&FLOOF LTD for any reason at any time.
BILLING, SUBSCRIPTION OR ‘FEE’ CHANGES
At the discretion of BOOP&FLOOF LTD subscription fees may change at any time. This may modify the subscription fee. Any changes to the subscription fee will be initiated at the end of the then-current billing period.
You will be notified of any changes by BOOP&FLOOF LTD prior to the changes being made. This will give you the opportunity to cancel your subscription before the renewal of your subscription.
Continued use of the preselected subscription after the fee changes constitutes your agreement to pay the changed subscription fee amount.
You may cancel your subscription at any time. Your selected subscription will run the months selected and will not automatically renew after this period.
BOOP&FLOOF may terminate or suspend you account immediately, without prior notice or liability, for any reason, including but not limited to breaching the Terms. Once termination has commenced your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Refunds can be request through the ‘Contact Us’ section of the BOOP&FLOOF website. Refunds will be considered by BOOP&FLOOF LTD on a case-by-case basis and will be granted at the discretion of BOOP&FLOOF LTD.
Refunds can also be requested by emailing email@example.com. To request a refund BOOP&FLOOF will need your full name, the email that is registered to your account and the reason for the refund. BOOP&FLOOF may request photographic evidence depending on the reason request. BOOP&FLOOF will then review your case. BOOP&FLOOF will then contact you by email within 3 working days. This may be extended for some cases.
Your first box will be shipped the next working day after your purchase and payment will be taken immediately.
All payment after month ‘One’ will be taken on the 7th
All boxes after month ‘One’ will be shipped on the 14th of each month.
Part of BOOP&FLOOF subscription services requires the use and purchase of other companies produce. These are not owned or controlled by BOOP&FLOOF.
BOOP&FLOOF is not connected, in control of and take no responsibility for their content, terms and conditions, privacy policies or services. By using or purchasing our any of BOOP&FLOOF products or services you acknowledge and agree that BOOP&FLOOF LTD is not responsible or liable, directly or indirectly for any damages or losses caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, services available on or through any such websites or services.
BOOP&FLOOF advise you to read the terms and conditions and privacy policies of any third-party websites or services that you view or use.
You agree to defend, indemnify and hold harmless BOOP&FLOOF LTD and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
LIMITATION OF LIABILITY
BOOP&FLOOF LTD, nor its directors, employees, partners, agents, suppliers, or affiliates shall be liable for any indirect, incidental, special, consequential or punitive damage of any kind in any event. This includes but not limited to loss of profits, use, data, goodwill or other intangible losses, resulting from: your access to or use of or inability to access or use the service, or: any content obtained from the service, any conduct or content of any third party on the service, unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort, negligence or any other legal theory, whether or not we have been informed of the possibility of such damage and even if a remedy set forth herein is found to have failed of its essential purpose.
Without limiting the generality of the foregoing and notwithstanding any other provision of these terms, under no circumstances will BOOP&FLOOF LTD ever be liable to you or any other person for any indirect, incidental, consequential, special, punitive or exemplary loss or damage arising from, connected with, or relating to your use of the Service, these Terms, the subject matter of these Terms, the termination of these Terms or otherwise, including but not limited to personal injury, loss of data, business, markets, savings, income, profits, use, production, reputation or goodwill, anticipated or otherwise, or economic loss, under any theory of liability (whether in contract, tort, strict liability or any other theory or law or equity), regardless of any negligence or other fault or wrongdoing (including without limitation gross negligence and fundamental breach) by BOOP&FLOOF LTD or any person for whom BOOP&FLOOF LTD is responsible, and even if BOOP&FLOOF LTD has been advised of the possibility of such loss or damage being incurred.
Your use of BOOP&FLOOF service or products are at your sole risk. The service and products provided by BOOP&FLOOF are based on a ‘AS IS’ and ‘AS AVAILIABLE’ basis. This service does not include warranties of any kind, whether express or implied including but not limited to, implies warranties or merchantability, fitness for a particular purpose, non-infringement or course of performance.
BOOP&FLOOF LTD its affiliates, subsidiaries and its licensors do not warrant that the service will function uninterrupted, secure or available at any time or locations, it does not warrants that any errors or defects will be corrected nor does it warrant that the service is free of viruses or other harmful components or the results of using the service will meet your requirements.
CHANGES TO T&C’s
At the discretion of BOOP&FLOOF LT, we reserve the right to change, modify or replace these Terms at any time. If the change is material BOOP&FLOOF will attempt to give 30 days prior notice to any new terms taking effect, what is considered a material change is determined at the discretion of BOOP&FLOOF LTD.
These terms are governed and construed in accordance with England and Wales laws, without regard to its conflict of law provisions. Any failure of BOOP&FLOOF to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provisions of these Terms is held to be invalid, or unenforceable in court for any reason, the remaining provisions of the Terms will remain in effect. These Terms constitute the entire agreement between us and regarding our products and services, they supersede and replace any previous agreements we might have between us regarding the service.
